Understanding the Legal Status of the Maui Coastal Land Trust

Hawai'i Land Trust (HILT) is a 501 (c), 3 Hawaii nonprofit organization and a nationally accredited land trust that covers all the islands of Hawaii. HILT understands the importance of Hāwea Point for the ohana (families) of this area and, potentially, as a resting place for the Kupuna Iwi. In 2004, HILT adopted the management of a conservation easement that covers approximately two acres. The legal status of the Maui Coastal Land Trust is complex. While the land title and jurisdiction along this coast are unclear, access to the water is protected by conservation easement.

James Crowe, ʻĀina custody manager of the Hawaii Land Trust, explains that “the trail is privately owned, but access to the water is protected by conservation easement”. The platform land is public, but the land above that part of the trail is private property and is not subject to conservation easement. The Hawaii Land Trust works to protect the lands that support Hawaii and educates future generations on how to do the same. Through its conservation easement, HILT ensures that access to the water along this coast remains protected. The organization also works to ensure that Hawaiians can continue to use this land for cultural and spiritual practices. The legal status of the Maui Coastal Land Trust is complex and ever-changing.

HILT works hard to ensure that access to this land remains protected for Hawaiians and future generations. This includes protecting Hawaiians' right to use this land for cultural and spiritual practices. HILT's conservation easement also helps protect this land from development and other activities that could damage it. This helps ensure that future generations will be able to enjoy this land in its natural state. Additionally, HILT works with local communities to ensure that they are aware of their rights and responsibilities when it comes to using this land. The legal status of the Maui Coastal Land Trust is complex and ever-changing.

However, HILT's conservation easement helps ensure that access to this land remains protected for Hawaiians and future generations. Through its efforts, HILT works hard to protect this land from development and other activities that could damage it.
